CASSATION COURT SUPPORTED A FINE UPON “PHARM SKD”

The administrative punishment is imposed for participating in a cartel  

Volga District Arbitration Court upheld FAS decision to fine “PHARM SKD” Ltd. 85,291,842.88 RUB. 

The anticompetitive agreement was concluded with “NOVOPHARM” OJSC and pursued through more than 400 auctions for supplying medicines, medical products, disinfectants and clinical nutrition in five regions of Russia. The sum of the initial maximum contract prices exceeded 400 million RUB.

The antimonopoly case was opened upon a statement of the active members of the “For Fair Procurement” Project of the All-Russia People’s Front.

Earlier, the Court of First Instance and the Appeal Court already supported FAS decision with regard to the anticompetitive agreement.

Head of FAS Anti-Cartel Department, Andrey Tenishev, pointed out “The existing law specifies significant fines for bid-rigging collusions. This is due to elevated public danger of such violations. It is essential that Court consistently supports the FAS position for both the fact of the violation and the punishment for it”.
