COURT CONFIRMED VORONEZH OFAS IN A DISPUTE WITH A UNITARY ENTERPRISE THAT UNREASONABLY OVERRATED TARIFFS FOR A NUMBER OF SERVICES
Consumers overpaid “Voronezh City Grid” Municipal Unitary Enterprise for the services in the field of the electric power industry and communications
As established, the unitary enterprise has the dominant position on the markets of services of assigning for temporary use of power poles to internet-providers (communications operators) to hang communications cables in Voronezh.
In 2017 the costs of the service increased by 116.2% in comparison with 2016.
An inspection revealed a fact that “Voronezh City Grid” included unreasonable expenses (labour norms, profitability and overheads) in the service price structure. Fixing the price, the company for the second time calculated the costs and profit already included by the Office of State Tariff Regulation in the Voronezh region in the services for electric power transmission.
Fir instance, “Voronezh City Grid” unreasonably double compensated the costs and gain profit paid by consumer of electric power transmission services as part of the relevant tariff and repeatedly by internet-providers (communications operators).
Voronezh OFAS found that the unitary enterprise abused dominance and violated Clause 1 Part 1 Article 10 of the Federal Law “On Protection of Competition”. “Voronezh City Grid” attempted to appeal the decision and order of the antimonopoly body at Court. The Arbitration Court of the Voronezh region dismissed the claim, however, and upheld the decision and order issued by Voronezh OFAS.
