RUSSIA IMPROVED ITS POSITION IN DOING BUSINESS 2019 (CONSTRUCTION)

Within a year, Russia moved 22 positions up in the World Bank ranking for “Dealing with construction permits” and is now on the 26th place among 190 analyzed countries*

 

These results are achieved through modernization of the sectoral law and reduction of administrative barriers in the construction industry. The Ministry of Construction of the Russian Federation and the Federal Antimonopoly Service undertake continuous efforts towards improving sector-specific legislation.

 

For instance, at the end of December 2019 amendments were made to the exhaustive list in the field of housing construction**.

 

“Particular procedures are added to the list, and at the same time some points in the documents are clarified and some procedures ceased to be in force”, informed Deputy Head of FAS Department for Control over Construction and Natural Resources, David Akopyan.

 

For example, the procedure on “giving a positive opinion regarding validity of estimated costs of capital construction facilities (applied in cases specified in regulatory acts of the Russian Federation) is cancelled due to adopting № 342-FZ Federal Law, according to which from 1 January 2019 the subject-matter of expert examination of project documentation comprises conformance evaluation of project documentation***.

 

The amendments also clarify the procedure for giving positive conclusions in expert examination of project documentation.

 

Head of FAS Department for Control over Construction and Natural Resources, Oleg Korneev reminded that actions of the authorities and network organizations undertaken in the course of fulfilling the procedures from the list can be fast-track appealed to the antimonopoly authority under four grounds: breaching the procedure time frame, fixing requirements that are not on the lists/not provided for by the current legislation, unlawfully refusing to accept documents.

 

Such kind of complaints must be considered and decisions should be made, with further issuing banding orders, in no longer than 14 days.

*** Technical regulations, sanitary-and-epidemiological requirements, environment protection requirements, particularly, design assignment from real estate developers or technical customers, results of engineering surveys and validity check of estimated costs of building capital construction facilities.
