Article 40. Protection of Competition in the Use of Water Bodies

(as amended by the Federal Law of 14.07.2008 N 118 – FZ)

1.Monopolistic activity and unfair competition in the use of water bodies are forbidden.

2.The Federal executive authorities, public authorities of the subjects of the Russian Federation, bodies of local self-government, other bodies or organizations, exercising functions of the bodies mentioned are forbidden to adopt acts and (or) take actions (inaction) as well as conclude agreements or take concerted actions in the use of water bodies that lead or may lead to the prevention of competition, its restriction and elimination.

3.The procedure of exercising the state control over economic concentration in the use of water bodies is established by the Government of the Russian Federation.
