On 10th May 2012, the Office of the Federal Antimonopoly Service in the Tomsk Region (Tomsk OFAS Russia) found that “SeverNefteProdukt” Ltd. violated the antimonopoly law in the part of abusing dominant position (Clause 1 Part 1 Article 10 of the Federal Law “On Protection of Competition”).
The Federal Antimonopoly Service (FAS Russia) found that participants of competitive bidding for supplying food products for the needs of the Ministry of Defence, the Federal Guard Service of the Russian Federation, the Ministry of Interior of the Russian Federation responsible for a collusion to maintain prices at the maximum level (in violation of Clause 2 Part 1 Article 11 of the Federal Law “On Protection of Competition”).
On 10th May 2012, the Federal Antimonopoly Service (FAS Russia) initiated a case on violating the antimonopoly law against “Yedinaya Torgovaya Kompania” OJSC, “Plastcard” OJSC, “Caustic” OJSC (of Sterlitamak), “Sibmanagement Group” Ltd. and “Sayanskchimplast” OJSC.
On 4th May 2012, representatives of the Federal Antimonopoly Service (FAS Russia) took part in a meeting organized by a member of the Collegium – the Minister for Competition and Antimonopoly Regulation of the Eurasian Economic Commission, Mr. Nurlan Aldabergenov, on the issues of influence of technical regulation on production and sales of alcohol products and related industries.
The Government of the Russian Federation made a decision to introduce changes to the Fundamental Provisions of Functioning of Retail Electric Power Markets. The new Retail Market Rules will protect the interests of bona fide consumers and suppliers, and enable developing competition and maintain reliability of electric power supply.
On 24th April 2012, the Federal Antimonopoly Service (FAS Russia) initiated a case against the Ministry of Agriculture of the Russian Federation (Rosselkhoz) upon signs of violating Part 1 Article 15 of the Federal Law “On Protection of Competition”.
The Office of the Federal Antimonopoly Service in the Primorie Region (Primorie OFAS Russia) carried out a scheduled inspection of a Regional Office of Rosimuschestvo [the Federal Agency for State Property Management] in the Primorie Region (Rosimuschestvo) to verify compliance with the antimonopoly law in transferring state property for use by commercial organizations.
The Courts of three instances supported the decision of the antimonopoly body of the Kostroma region regarding “Kostroma Sales Company” OJSC (“KSK” OJSC). The company abused its market dominance on the market of energy supply. The company restricted energy supply to “Voronyo” Housing Services and Utilities” Municipal Unitary Enterprise by switching off water supply intake in Stolbovo village.
The Office of the Federal Antimonopoly Service in the Penza Region (Penza OFAS Russia) found that the company violated the antimonopoly law by refusing to supply gas to boiler-houses because of an outstanding debt. On 3rd May 2012, Penza Regional Arbitration Court pronounced legitimacy of the decision and determination of Penza OFAS regarding “Gazprom Mezhregiongaz Penza” Ltd. and an order issued by OFAS to impose a 650,000 Rubles fine.
On 27th April 2012, the Federal Antimonopoly Service (FAS Russia) terminated a case against “Sovkombank” Investment Commercial Bank” Ltd. and “ALIKO” Insurance Company” CJSC due to absence of violating Part 4 Article 11 of the Federal Law “On Protection of Competition”.
