FAS will not open a case against “Transammiak” OJSC
Moscow Arbitration Court confirmed legitimacy of FAS decision not to open a case against “Transammiak” OJSC.
Earlier, “Minudobrenia” OJSC petitioned to FAS about elements of violating the antimonopoly law by “Transammiak” OJSC.
Having looked into specific details, the Antimonopoly Service decided against opening a case with regard to the Russian company involved in ammonia transportation. “Minudobrenia” OJSC disagreed with the FAS decision and filed a claim to Moscow Arbitration Court.
Having examined all evidence, the Arbitration Court has established that the antimonopoly body arrived to the correct conclusion that actions of “Transammiak” OJSC had not had any signs of violating the Federal Law “On Protection of Competition”. Thus, the Arbitration Court upheld FAS decision and dismissed the claim of “Minudobrenia” OJSC.
The Head of FAS Department for Control over Chemical Industry and Agro-Industrial Complex, Anna Mirochinenko, pointed out: “In the course of arbitration FAS submitted exhaustive evidence confirming legitimacy of the methods used by the antimonopoly body to analyze pricing of the dominant economic entity”.
