Appeal Court did not allow reducing a fine upon a participant of a cartel formed by suppliers of rehabilitation needs for the disabled
The 15th Arbitration Appeal Court reversed a judgment of Krasnodar Regional Arbitration Court on reducing a fine upon “April” Ltd. from 1.8 million RUB to 100,000 RUB.
The fine was imposed for concluding and participating in a cartel that resulted in maintaining prices in the course of competitive bidding for rehabilitation needs for the disabled. The cartel members were fined in total over 7.3 million RUB.
“April” Ltd. appealed to the Arbitration Court that reduced the fine from 1.8 million RUB to the minimum. The Appeal Court, however, reversed the judgment.
Deputy Head of FAS Anti-Cartel Department, Mukhamed Khamukov commented: “The Appeal Court objectively considered the circumstances of the violation committed by the company and emphasized that the fine imposed upon “April” Ltd. is adequate”.
