FAS dismissed a Google’s petition on prolongation of Ruling execution

On September, 2, 2016 the FAS Russia dismissed a petition of Google Inc. and Google Ireland Limited on prolongation of the period of the execution of FAS Russia’s ruling on case of violation of antimonopoly legislation and made a decision on refuse of its satisfaction. Applicants required prolongation for every particular point of ruling- from 6 to 12 months.

 

The FAS Russia had already extended the ruling execution period for one month (till December, 18, 2015) on a similar request from Google 10 months before. That time it was made because of ongoing workload and pace of deadlines - the reasons which were declared by applicant.

 

This time the applicants referred the same reasons for extending execution and didn’t offer any evidence that there were any circumstance’s changes since the first petition had been approved. Furthermore, the petition made with violation of time limits established on Federal Law "On Protection of Competition".

 

It will be recalled that the Moscow Arbitration court’s decision of March 15, 2016 upheld the resolution of the Ninth Arbitration Appeal Court of 19 August 2016 and the companies Google Inc and Google Ireland Limited were rejected in satisfaction of the claim for a recognition illegal decisions and orders of the FAS Russia dated September, 18, 2015 No 1-14-21/00-11-15.

 

Taking into account that Google Inc. and Google Ireland Limited did not execute ruling in time the FAS Russia now is in preparation for the administrative investigation for failure the execution of the Ruling.
