FAS opened a case against “Apple Rus” Ltd.
Guided by Part 12 Article 44 of the Federal Law “On Protection of Competition”, the Federal Antimonopoly Service (FAS Russia) opened a case against “Apple Rus” Ltd.upon elements of violating Part 1 Article 10 of the Law (abusing dominance by an economic entity).
The order on opening a case and forming the Commission to investigate a case on violating the antimonopoly law was signed on 7 December 2016.
FAS finds elements of “Apple Rus” Ltd. breaching Part 1 Article 10 of the Federal Law “On Protection of Competition” in failure to ensure using goods within their lifecycle. I.e., absence of supplies of components (screen modules and bother boards) required for repair to the Russian Federation), as a result of which the interests of consumers at large are infringed.
Article 10. Prohibiting abusing dominance by an economic entity
1. Actions (omissions) of an economic entity with the dominant position that result or can result in preventing, restricting, eliminating competition and (or) infringing their interests of other persons (economic entities) in the field of entrepreneurial activity or consumers at large, are prohibited, including the following actions (omissions).
