FAS exposed discriminatory conditions created by certification bodies
The Antimonopoly Service issued warnings to the companies certifying cement products
Mandatory cement certification is in effect from March 2016 (No.930 Decree of the Government of the Russian Federation “On amendments to the unified list of products subject to mandatory certification” of 03.09.2015.
FAS has found that “Cemiscon” Ltd. and “SibNIIcement” Ltd. refused some applications for mandatory cement product certification without well-reasoned grounds as to why certification could not be performed under the National Standard of the Russian Federation GOST R 56836-2016 “Evaluating conformity. Cement Certification Rules”. Such actions could restrict competition on the cement market.
“Documents examined by FAS helped establish that unreasonably refusing to certify cement products “Cemiscon” Ltd. and “SibNIIcement” Ltd. created discriminatory conditions on the cement market”, explains Deputy Head of FAS Department for Industry Control, Elena Filashina.
FAS warned “Cemiscon” Ltd. and “SibNIIcement” Ltd. to stop actions that had signs of breaching Clause 8 Part 1 Article 15 of the Federal Law “On Protection of Competition”. The companies are obligated to suggest to the economic entities, whose applications were rejected without well-reasoned grounds, to perform certification in full compliance with the National Standard.
