FAS warned “Rosneft” for discriminating potential buyers
“Rosneft” NK” PJSC refused to enter into a contract with “Ashaorgsynthez” for supplying alcohol used to produce ethyl acetate. The company’s actions have elements of restricting competition
“Ashaorgsynthez” Ltd. complained tothe Federal Antimonopoly Service (FAS Russia) that “Rosneft” NK” PJSC refused to conclude a contractfor supplying synthetic industrial denaturated ethyl acetate.
FAS established that “Rosneft” failed to consider the offers of “Ashaorgsynthez” due to inconsistencies with in-house regulatory documents, devised by the company for potential buyers of petroleum commodities, oil and gas products and petrochemicals.
Since “Rosneft” has the dominant position on the market of denaturated ethyl acetate, discriminatory conditions for potential buyers can lead to competition restriction (signs of breaching Clause 5 Part 1 Article 10 of the Federal Law “On Protection of Competition”).
Head of FAS Department for Control over Chemical Industry and Agro-Industrial Complex, Anna Mirochinenko pointed out: “Under the antimonopoly law, a company with the dominant position must enter into contracts if it has a possibility to produce or supply goods. Within 30 days upon receiving the warning, “Rosneft” must consider the offers of “Ashaorgsynthez” and agree with FAS a new version of the regulations on “Rosneft” NK” PJSC, removing from it economically or technologically unjustified criteria for evaluating conformance of potential buyers”.
