Murmansk Regional Housing Inspection was warned by the regional antimonopoly body
Actions undertaken by the housing authority has signs of restricting competition on the market of apartment blocks management
Murmansk OFAS issued a warning to the Sate Housing Inspection (SHI) in the Murmansk region to eliminate the signs of violating the antimonopoly law (Part 1 Article 15 of the Federal Law “On Protection of Competition”).
OFAS established that apartment owners had chosen “ZhEK” Ltd. as the managing organization.
Agreements with previous managing companies were terminated and a new agreement was signed with “ZhEK” Ltd. for three years.
Governed by the existing law, the company approached Murmansk Regional State Housing Inspection to include the apartment blocks in the License Register of the Murmansk region as managed by “ZhEK” Ltd.
The Housing Inspection refused the application due to non-conformity of the submitted documents. According to SHI they did not comply with the law.
Murmansk OFAS established that the company submitted all necessary documents and performed all required actions.
Thus, actions undertaken by Murmansk Regional State Housing Inspection in the part of refusing the application of “ZhEK” Ltd. to amend the License Register of the Murmansk region prevented operations on apartment block management, which could have restricted competition.
Murmansk OFAS issued a warning to the Housing Inspection to include the apartment blocks in the License Register of the Murmansk region by 01 March 2017 for “ZhEK” Ltd. exercising apartment blocks management from October 2016.
If SHI fails to execute the warning, Murmansk OFAS will open an antimonopoly case against SHI.
