The Ministry of Health Care executed a warning of the Antimonopoly Service
FAS was notified by the Ministry of Health Care of the Russian Federation on executing the warning of the antimonopoly body and eliminating elements of unreasonably preventing operations by economic entities
In the FAS opinion, the Ministry selectively executed Clause 6(1) of the Rules for keeping the Price Register for Life-Saving and Essential Drugs * in the part of amending the Resister entry on the state registration of the maximum ex-works prices for medicinal drugs in case of changing their set completeness (provided there are no absence in the quantity of drugs in secondary (consumer) package), making different decisions on similar applications, which prevented operations of economic entities.
Head of FAS Department for Control over Social Sphere and Trade, Timophey Nizhegorodtsev emphasized: “Earlier actions by the Ministry of Health Care of the Russian Federation on executing Clause 6(1) of the Rules for keeping the Price Register for Life-Saving and Essential Drugs already have been in the focus of FAS attention. Hopefully, two warnings would suffice and the legal rights of pharmaceutical companies in the part of reregistering the maximum ex-works prices for medicinal drugs will be observed”.
