Andrey Tsyganov: most explanations of the antimonopoly law are a symbiosis of economy and law

On 24 March 2017, the Antimonopoly Forum of the Corporate Counsel Association discussed uniformity of applying the antimonopoly law

The first session at the Forum discussed controversial issues of applying warnings and admonitions as preventative measures against violations of the antimonopoly law, and FAS draft explanations on applying Article 10 of the Federal Law “On Protection of Competition”.

Head of FAS Legal Department Artem Molchanov outlined the first experience of antimonopoly appeal and answered questions regarding interpreting and the effect of the antimonopoly law.

“Traditionally, FAS and the Corporate Counsel Association organize the Antimonopoly Forum designed to mainstream enforcement of the antimonopoly law in the expert environment”, explained Deputy Head of FAS Andrey Tsyganov who moderated the session. “Most explanations of the antimonopoly law are a symbiosis of economy and law. We were able to reduce the number of antimonopoly cases nearly twofold thanks largely to the system of preventative control. We endeavour to make sure that the society has no place for violations of the antimonopoly law”.

President of the Corporate Counsel Association (CCA) Alexandra Nesterenko expressed gratitude to FAS top-officers for the openness and readiness for a dialogue and cooperation with CCA in various formats: active FAS involvement in the annual CCA Antimonopoly Forum, Round Tables, and CCA response to draft regulatory acts devised by FAS.

2016 was the year of eager and productive efforts to devise explanations of FAS Presidium by the Working Group of FAS and the Corporate Counsel Association. “At the end of last year FAS Presidium approved the first explanation on applying Article 9.21 of the Code of the Russian Federation on Administrative Violations (in the balance with Article 14.31 of the Code on Administrative Violations”, reminded Alexandra Nesterenko. “Soon the Presidium of the antimonopoly authority will consider draft FAS explanations on applying Article 10 of the Federal Law “On Protection of Competition”. These efforts will enhance legal certainty of operations of economic entities and uniformed enforcement”.
