“Gazpromneft Moscow Refinery” JSC paid a fine

The company did not submit data to the antimonopoly authority on electric power transmission to particular consumer categories

FAS fined “Gazpromneft Moscow Refinery” JSC 50,000 RUB. The company failed to submit information required in accord with the form for federal statistic observation. The obligation is formalized by an order issued by Rosstat [Russian State Statistical Service]*.

Earlier, Head of FAS Department for Regulating the Electric Power Industry, Dmitry Vasiliev pointed out that data on electric power transmission to particular consumer categories is one the basic elements of ensuring demand and reliable power supply and stated that balanced tariffs decision-making depends on timely submissions of such information.

“The antimonopoly body exercises control on a regular basis over submitting information by participants of the wholesale and retail electric power markets”, added Dmitry Vasiliev. “Administrative measures enable to promptly suppress such violations and enhance reporting efficiency of regulated organizations in the future”.

* No. 257 Rosstat Order of 03.07.2013 specifies that No. 46-EE Form (transmission) must be filled in the FAS system monthly (by the 20th day after the reporting month) and annually (by 10th February  of the reporting year) to prepare consolidated  balance forecast of electric power (capacity) generation and supply within the Integrated Energy System of Russia.

Part 1 Article 19.7.1 the Code on Administrative Violations establishes liability failure or late submission of information to the body exercising state control (supervision) over state-regulated prices (tariffs) if submitting such information is mandatory under regulatory acts in order to set, change, introduce or abolish tariff in the form of an administrative fine:

- For officials – from 3000 RUB to 5000 RUB

- For legal entities – from 50000 RUB to 100000 RUB.
