FAS terminated proceedings against Tuapse Commercial Seaport
On 30 May 2017 FAS closed an antimonopoly investigation against “Tuapse Commercial Seaport” JSC (“TMTP” JSC). FAS did not find any signs of the stevedore abusing its dominant position.
“FAS Commission concluded that in spite of the absence of developed competition, Tuapse Commercial Seaport had not abused its dominance”, pointed out the Commission Chairman, Deputy Head of FAS Alexander Red’ko. We also took into account that “TMTP” actively invests its profit in Tuapse Port infrastructure, which has increased transshipment: currently the port is nearly 100% loaded with cargo that arrived by rail”.
The Commission also stated that Tuapse Commercial Seaport had undertaken significant efforts to execute the orders of the President of the Russian Federation and that the prices set by “TMTP” were considerably below the tariffs set by Novorossiysk Commercial Seaport that also operates in the Azov – Black Sea basin.
“The company has completed considerable work to execute the orders of the President of the Russian Federation; the stevedore set the rates for transshipment services in Rubles, published detailed information about the tariffs and application registers on the corporate web-site, and ensures direct access to its services”, summed up Alexander Red’ko.
The antimonopoly investigation against companies involved in cargo loading / unloading and storage services in seaports of the Russian Federation started in June 2016. The cases were opened upon the findings of a survey of the stevedore service market carried out on instructing from the President and the Government of Russia.
