Failure to submit information about transferring electric power to particular categories of consumers resulted in a fine

On 20 June 2017, to exercise the powers to control government-regulated prices (tariffs), FAS imposed the minimum fine upon “Regional Energy Company” JSC – 50,000 RUB in view of the mitigating circumstances.

The company failed to submit information required by No. 46-EE Form of federal statistical monitoring (submission), in breach of No. 257 Rosstat [Federal State Statistical Service] Order of 3 July 2013.

Deputy Head of FAS Department for Regulating the Electric Power Industry, Sergey Dudkin pointed out: “Actual data on electric power transmission to particular categories of consumers are used to form a consolidated balance forecast of production and supplies of electric power (capacity) in the Integrated Energy System of Russia by the subjects of the Russian Federation. Jointly with “FAS Information-and-Technical Centre” we monitor on the quarterly basis information submission by market participants, and administrative actions enable us to suppress violations related to failure to observe the law on government regulation of prices (tariffs)”.

Part 1 Article 19.7.1 of the Code of the Russian Federation on Administrative Violations establishes liability in the form of an administrative fine for failure or late submission of information to the body that exercises government control (supervision) over regulated prices (tariffs) if submitting such information is mandatory in accord with the normative legal acts to set, change, introduce or abolish tariffs:

- Upon officials - from 3000 RUB to 5000 RUB  

- Upon legal entities – from 50,000 to 100,000 RUB.

Reference:  No. 257 Rosstat Order of 03.07.2013 states that No. 46-EE Form (submission) should be filled in within the FAS system monthly (by 20th day after the reporting month) and annually (by 10th February for the  reporting year) to compile consolidated balance forecast for production and supplies of electric power (capacity) in the Integrated Energy System of Russia.
