FAS needs consumers’ opinions to determine substitutability of traditional communications services and modern OTT-services.

FAS is investigating a case against “Megafon” PJSC upon signs of violating Clause  1 Part 1 Article 10 of the Federal Law “On Protection of Competition” , increasing tariffs for communications services in international roaming.  

FAS Commission must determine whether traditional communications services (voice, SMS-messages, data transfer) and modern OTT-services (WhatsApp, Viber, Telegram, Skype, FaceTime, iMessage messengers, etc.)  are substitutes. Consumersopinionsare decisive in this context.

Messenger programs are used via data transfer network (the Internet). It can be services of cellular providers, and in this case Internet access services are fee-based, or it can be Internet access services from a different provider, particularly, home Wi-Fi, free public Wi-Fi in hotels, parks, airports.
