FAS fined “Enegosbyt Plus” three times - in total for 900,000 RUB

The company failed to execute a determination of the antimonopoly body issued under the frame of state control over economic concentration

FAS considered the petitions for consolidating assets of “Enegosbyt Plus” OJSC. Based on the results, the Antimonopoly Service issued injunctions.

Since concluding the deals, within each month from 9 to 21 hours (inclusively) on work days the announced consumption with regard to supply points (point groups) must not exceed the actual consumption because it increases prices on the wholesale and retail electric power markets.

In these point suppliers of last resort for “Enegosbyt Plus” OJSC acquire electric power in the wholesale market in order to sell on the retail market.

“The injunction is aimed at reducing the number of “upward” deviations from the suppliers of last resort of the group of companies of “T Plus” PJSC, which may increase prices for consumers on the wholesale and retail electric power markets”, pointed out Head of FAS Department for Regulating the Electric Power Industry, Dmitry Vasiliev. “Such fines must be perceived not as punishment but as a stimulating measure for quality planning of power consumption in the future”.

Therefore, “Enegosbyt Plus” OJSC committed violations under Part 2.3 Article 19.5 of the Code of the Russian Federation ion Administrative Violations.

Under Part 6 Article 25 of the Federal Law “On Electric Power Industry”, in accord with the procedures established by the antimonopoly law of the Russian Federation, in view of the specifics determined by the Government of the Russian Federation, an economic entity can be forcibly split off for repeatedly abusing dominance, particularly, if such an entity manipulates prices on wholesale or retail markets or other monopolistic activity.
