The State Duma adopted amendments to the Code on Administrative Violations in the first reading

FAS drafted the Federal Law “On making amendments to the Code of the Russian Federation on Administrative Violations” to form the system of control and responsibility for failure observe the Information Disclosure Standards in heat supply.

On 12 July 2017 Deputy Head of FAS Vitaly Korolev presented the draft law for consideration by the State Duma. The document was adopted in the first reading.

The draft law proposes to adjust Articles 9.15 and 19.8.1 to unify administrative liability for the subjects of the electric power industry and heat supply. For instance, Article 9.15 has a new element of offence – knowingly submitting false information, and Article 19.8.1 – a new liable party – heat suppliers.

The project also formalizes the powers of the federal antimonopoly body to hold tariff regulators of the subjects of the Russian Federation administratively liable under Article 19.8.1 of the Code on Administrative Violations for breaching the Information Disclosure Standards. Under the Information Disclosure Standards, the subjects obligated to disclose the relevant information are heat suppliers, the network companies, the regulators and FAS. Liability for violations falls only upon holders of natural monopolies.

In the part of breaching the Information Disclosure Standards by organizations everything remains unchanged:  tariff regulators of the subject of the Russian Federation still will continue holding them liable.
