Court pronounced legitimacy of FAS decision regarding Rosreserv
The Federal Agency on State Reserves (Rosrezerv) unlawfully dismissed a claim filed by a bidder of an auction for buying-and-selling oil products
In December 2016, the Federal Agency on State Reserves held an auction for the right to conclude a contract for buying-and-selling oil products, released from the state reserves in 2017.
“Atlant and Co.” Ltd. complained to FAS about the actions of the auction organizer. Rosreserv rejected its bid because a copy of the company’s Statute was not duly certified.
“The antimonopoly body established that the claimant enclosed a copy of the Statute, which was notarized. Therefore, the auction organized should not have any grounds to doubt the authenticity of the document. The refusal of the Federal Agency on State Reserves to accept the bid of “Atlant and Co.” Ltd. was unlawful”, pointed out Head of FAS Department for Control over Construction and Natural Resources, Oleg Korneev.
Rosreserv disagreed with the FAS decision and filed a lawsuit. Moscow Arbitration Court dismissed the claim and supported the position of the antimonopoly body.
