FAS issued a warning to the Ministry of the Ulyanovsk region for Construction, Housing-and-Utilities Sector and Transport
A public statement in a print media indicates an intention of the Government ofthe Ulyanovsk region to enter into a concession agreement contrary to the law
On 30 June 2017, mass media published an article “Water Services Company is overwhelmed with concessions. Dimitrovgrad authorities replay their conditions”, where the Minister of the Ulyanovsk region for Construction, Housing-and-Utilities Sector and Transport made a statement that “...It does not matter whether or not RKS or other private companies submit applications: “Ulyanovsk Regional Water Services Company will be a concessioner who will propose these conditions.
Deputy Head of FAS Vitaly Korolev said: “It’s worth reminding that Russian law provides for competitive selection of concessioners. Concluding a concession agreement with regard to Dimitrovgrad water supply facilities exactly with Ulyanovsk Regional Water Services Company without observing the established procedures will result in violating the law”.
FAS warns not to exercise the planned actions (omissions) since such conduct can lead to breaching the Federal Law “On Protection of Competition” (Part 1 Article 15, Part 1 Article17).
