Appeal Court supported FAS in a case against collusion of producers of oil-submersible cables
The 9th Arbitration Appeal Court upheld the verdict of Moscow Arbitration Court to pronounce legitimacy and reasonableness of FAS decision on a case against “Kama Cable” Ltd., “POSSKAT” OJSC, “Kavkazkabel” Cable Plant” JSC, “Cable Alliance Holding” Ltd., “Uralkabel” JSC, and “Sibkabel” JSC.
In June 2016 FAS found that manufacturers of oil-submersible cables concluded and implemented an anticompetitive agreement, dividing the sales market of submersible cables (except the high-temperature segment) in 2014-2015, fixing market shares for each cartel participant and refused to apply a competitive methods of determining product prices.
Cartel members are held administratively liable in the form of turnover fine for the total sum exceeding 250 million RUB.
Head of FAS Anti-Cartel Department Andrey Tenishev said: “The legal position of the Courts o cartel cases is significant for exposing and suppressing anticompetitive agreements”.
