7 criminal cases are opened in the Ulyanovsk region upon OFAS materials

The Authority of “Sursky District” municipality purchased a building of a pre-school institution without competitive procedures. Similar violations were exposed in other 5 districts of the Ulyanovsk region

In 2016 Ulyanovsk OFAS carried out a scheduled inspection of the authority of “Sursky District” municipality in the Ulyanovsk region. The inspection revealed violations of the antimonopoly and other branches of law in construction and purchasing of a day-care centre building without tenders.

OFAS specialists proved that the Ministry of Education and Science of the Ulyanovsk region and the Authority exercised actions in agreement designed to acquire the day-care centre building in breach of the Law on the contractual system. The sum of every contract for the day-care centre building for 60 persons exceeded 41 million RUB.

The deliberate actions by the Ministry of Authority and the builders were aimed at financing the purchasing of the day-care buildings that were constructed along with the actions of the government agencies on allocating financing, and from the outset met the requirements set by the Ministry.

For these violations OFAS imposed 17 fines upon the guilty persons from the Ministry of Education and Science of the Ulyanovsk region and the District Authorities, as well as construction companies and their top executives.

“OFAS has submitted the documents for disqualification of an official of one of the District Authorities to Court”, emphasized Head of Ulyanovsk OFAS Gennady Spirichagov.

Courts supported the position of Ulyanovsk OFAS, recognizing legitimacy of their decisions on the merits of the case and injunctions to punish officials.

Head of Ulyanovsk OFAS Gennady Spirichagov pointed out: “Signs of violations of a number of federal laws exposed by specialists of Ulyanovsk OFAS in the course of a scheduled inspection of a District Authority of a District Authority resulted in initiating antimonopoly cases under Article 16 of the Federal Law “On Protection of Competition” against the authorities of several Districts and then criminal cases. Here we deal with a striking example of successful cooperation between the Antimonopoly Service and the law enforcement bodies”.

The case materials were transferred to the law enforcement bodies. Criminal cases are opened under Part 1 Article 286 of the Criminal Code of the Russian Federation (abuse of office), the punishment can be imprisonment for up to 4 years.
