FAS ISSUED A WARNING FOR IMPOSING DISADVANTAGEOUS CONDITIONS OF A GAS SUPPLY CONTRACT
On 5 December 2017, FAS issued a warning to “Gazprom Mezhregiongaz Omsk” Ltd. to eliminate signs of a violation: imposing disadvantageous conditions of a gas supply contract (Part 1 Article 10 of the Federal Law “On Protection of Competition”).
To take part in exchange trading with natural gas, the companies – consumers must notify suppliers of natural gas on reducing the scope of consumption under off-exchange contracts in order to avoid doubling the volumes.
“Gazprom Mezhregiongaz Omsk” Ltd. restricted possibility of “Omsktekhuglerod” Ltd. to adjust gas volumes under off-exchange contracts after taking part in exchange trading. These actions infringed the interests of a bidder at on-exchange trading with natural gas.
According to the warning, the company should undertake measures to eliminate signs of the violation by sending signed contract offers to “Omsktekhuglerod” Ltd. for gas supply, determining the conditions for adjusting gas supply volumes under the contracts enabling “Omsktekhuglerod” Ltd. to promptly adjust the scope of consumption of natural gas for the next month.
