THE PRESIDENT OF THE RUSSIAN FEDERATION SIGNED A DRAFT LAW ON AMENDMENTS TO THE CODE OF THE RUSSIAN FEDERATION ON ADMINISTRATIVE VIOALTIONS

FAS drafted the new law to form a system of control and liability for non-compliance with the Information Disclosure Standards in heating supply

 

On 28 December 2017, the President of the Russian Federation Vladimir Putin signed a draft Law on amendments to the Code of the Russian Federation on Administration Violations. The Law adjusts Articles 9.15 and 19.8.1 to unify administrative liability for participants of the markets of electric power and hearting supply. For instance, Article 9.15 specifies a new offence – providing knowingly false information, and Article 19.8.1 – a new liable party: heat suppliers.

 

These changes formalize FAS powers on holding tariff regulators of the subjects of the Russian Federation administratively liable under Article 19.8.1 of the Code on Administration Violations for breaching the Information Disclosure Standards. Until the amendments came into effect, the Information Disclosure Standards specified that heat suppliers, heating networks and tariff regulators were obligated to disclose the relevant information. Liability for violations was specified only for natural monopolies.

 

The Law came into force on 1 January 2018.

 

Deputy Head of FAS Vitaly Korolev emphasized: “FAS undertakes systemic efforts on improving the system of control and liability for failure to observe the Information Disclosure Standards in heating supply. The amendments to will better ensure transparency of participants of the heat supply market, which ultimately will have positive effect upon protecting consumer interests”.
