IN THE INTERESTS OF NATIONAL SECURITY WE HAVE TO RECONSIDER THE METHODS FOR PROTECTING INTELLECTUAL PROPERTY IN THE PHARMACEUTICAL INDUSTRY
Efforts on obtaining the balance between private and public interests are reflected in the National Competition Development Plan.
Speaking at the “Pharmaceutical Lounge” of “R-Pharm”, Head of FAS Department for Control over Social Sphere and Trade, Timophei Nizhegorodtsev stated: “The primary task of the state is to protect people. FAS has submitted a document to the Cabinet of Ministers that in order to protect health and safety of the population entitles the Government to grant permits for use of inventions, utility models or commercial prototypes without a holder’s consent, notifying the holders as soon as possible and paying adequate compensations to the holders. This work is reflected in the National Competition Development Plan, approved by an Order of the President of the Russian Federation at the end of 2017”.
The right should be come a decision if the right holders abuse their dominance position by fixing and maintaining economically high prices, refusal to produce or supply the necessary medicines and medical products to the Russian Federation where there are serious threats to heath and safety of the population.
Finally, he reported that the dialogue between business and the authorities regarding intellectual property law in the pharmaceutical industry involving international expert community will continue at the industry section of St Petersburg Legal Forum.
