From 7 March bidding for the right to conclude contracts for use of fish-farming plotswill take place in the electronic form


No.185 Decree of the Government of the Russian Federation* came into effect, improving the current model of forming and allocating fish-farming plots for aquacultures. From 7 March 2018 bidding for the right to conclude contracts for use of fish-farming plots shall take place in both hard copy and electronic forms.


Upon a FAS initiative, fish-farming plots will be traded on e-sites operating in accord with the law on contractual system. Notices about e-auctions and all information related to them will be published on their web-sites and on torgi.gov.ru.


The Decree also formalizes the sequence of actions when the auction winner refuses to conclude the contract. In this case the right to use the plot will be transferred to the bidder whose offer was second to the auction winner’s offer. The Decree also obligates to enter into a contract with the single bidder of an e-auction.


Deputy Head of FAS Rachik Petrosyn stated: “The mechanisms proposed by FAS will help eliminate regulatory barriers, ensure information transparency of allocating fish-farming plots, and facilitate prevention of anticompetitive actions of the authorities and e-sites operators, which in their entirety will create a maximum favourable competitive environment. Making competitive bidding electronic will increase confidentiality of bidders and minimize the subjective factor in evaluation of the bids by the organizers”.


The Decree also introduces a moratorium for concluding a contract: no earlier than ten days and no later than twenty days after publishing the information about the outcome of an e-auction. It will allow the bidders to appeal actions of the organizers to FAS under the fast-track procedure: the complaint will be considered within seven days.
