“ROSTELECOM” IS WARNED THAT IMPOSING DISADVANTAGEOUS CONTRACT CONDITIONS AND CREATING DISCRIMINATORY CONDITIONS IS UNACCEPTABLE
On 4 April 2018 FAS issued a warning to “Rostelecom” PJSC to stop violating the antimonopoly law.
The grounds for the warning were a statement of “MTS” PJSC on possible violation by “Rostelecom” PJSC of the antimonopoly law for making available for use digital communications channels by means of underwater fiber-optical communications lines connecting Kamchatka, Sakhalin and Magadan.
FAS analyzed the conditions of similar contracts for making available for use digital communications channels concluded between “Rostelecom” PJSC and other operators and revealed elements of violating Clauses 3 and 8 Part 1 Article 10 of the Federal Law “On Protection of Competition”.
The elements of violation included imposing disadvantageous contract conditions in the part of restricting possibility to sub-lease digital communications channels and creating discriminatory conditions through fixing unreasonably different prices for the services on making available for use digital communications channels.
“Rostelecom” PJSC must execute the warning by 25April 2018.
