FAS: ROSGOSTSIRK VIOLATED THE FEDERAL LAW ON COMPETITION

The company transferred the rights for state property use without competitive bidding

Earlier the General Prosecutor’s Office forwarded a complaint of a physical person to FAS about actions of the Russian State Circus Company [Rosgostsirk] in the course of state property disposition.

As FAS Commission established, in breach of Clause 1 Part 3 Article 17.1 of the Federal Law “On Protection of Competition” Rosgostsirk transferred the rights for use of real estate for commercial goals (selling souvenirs, toys, buffet service, etc.) without competitive bidding. The unlawful scheme of state property disposition was registered at the branches of Rosgostsirk in the Bryansk, Voronezh, Rostov, Sarratov, Volgograd, Stavropol, Krasnodar and Nizhny Novgorod regions.

Deputy Head of FAS Rachik Petrosyan emphasized: “Rosgostsirk is issued an injunction to eliminate the violations. In the future, transferring such rights should take place through competitive bidding. Concluding the contract for the right to use state property based on the results of competitive bidding allows concluding the contract on a competitive basis: among the wide circle of participants and at the best price”.
