COURT CONFIRMED: THE FEDERAL GRID COMPANY BREACHED THE RULES FOR NON-DISCRIMINAOTRY ACCESS

The monopolist disagreed with an order of Moscow OFAS and appealed the fine at Court

 

The 9th Arbitration Appeal Court, however, confirmed legitimacy of the order of the antimonopoly body to fine “FGC UES” PJSC for breaching the Rules for non-discriminatory access.

 

Moscow OFASestablished that the monopolist had been avoiding for a long time a contract for electric power transmission with a counteragent. It resulted in breaching the deadline set by the Rules for non-discriminatory access, for which “FGC” was held administratively liable.

 

The grid company disagreed with the actions of the Antimonopoly Service and attempted to challenge them at Court. The 9th Arbitration Appeal Court, however, like to Court of First Instance confirmed legitimacy of the position taken by Moscow OFAS.
