TIMOPHEI NIZHEGORODTSEV: REGULATORY SYSTEM MUST PROTECT INNOVATORS BUT DO NOT ALLOW THEM TO EXPLOIT SUCH INNOVATIONS
The antimonopoly body believes that to protect life and health of the population, the Government of the Russian Federation must have the right of use forced licensing
“Regulation over circulation of medicinal drugs must correspond to the health care priorities in Russia – registration of innovative drugs, free access to the market, and availability of medication and provision of necessary drugs to patients. We must create such a regulatory system that appreciates innovations, protect innovators but do not allow them to predatory exploit these innovations, damaging public interests”, sated Head of FAS Department for Control over Social Sphere and Trade, Timophei Nizhegorodtsev, at the business-summit of the VI Eastern Europe and Central Asia HIV/ AIDS International Conference - ЕЕСААС 2018.
The antimonopoly body believes that to protect life and health of the population theGovernment of the Russian Federation must be assigned the right to grant permits for use of inventions, utility models or industrial prototypes without consent of the patent holder, notifying the latter as soon as practicable and paying an adequate compensation.
He clarified: “Today there are risks of the right-holders abusing their dominance in the form of fixing and maintaining economically unreasonable high prices, refusing to manufacture or supply the necessary drugs and medical products to the Russian Federation. In the interests of national security, live and health of the population should be protected. A relevant draft law is supported by the Government”.
Head of FAS Department reported that the antimonopoly body intends to enquire information from Russian manufacturers about the necessary capacities and the readiness to reproduce foreign innovative drugs if manufacturers refuse to supply patent-protected drugs to Russia.
The VI Eastern Europe and Central Asia HIV/ AIDS International Conference - ЕЕСААС 2018 took place in Moscow on 18 - 20 April. The Conference is a professional platform for devising proposals designed to withstand the spread of HIV. Attendees included representatives of the authorities, medical and academic communities, pharmaceutical companies and patient organizations.
