MUHAMED KHAMUKOV: DECARTELIZATION OF ROAD FACILITIES IS ONE OF THE MEASURES FROM THE NATIONAL COMPETITION DEVELOPMENT PLAN
Deputy Head of FAS Anti-Cartel Department Mukhamed Khamukov made this statement at a hand-on workshop on procurement organized by “Russian Auction House” JSC, “Electronic Market Professionals” Non-Profit Partnership and the Federal Highway Agency of the Ministry of Transport of the Russian Federation on 17-18 April in Yalta.
The workshop participants discussed the enforcement trends and new amendments to the law on procurement.
Muhamed Khamukov pointed out that construction and road maintenance are among the “leaders” in terms of susceptibility to cartelization. It is confirmed by many anticompetitive agreements exposed by FAS and its regional Offices. He gave examples of decisions made by the antimonopoly bodies and criminal cases opened recently in Tuva, Udmurtia and the Novgorod and Penza regions upon signs of offences under Article 178 of the Criminal Code of the Russian Federation.
“First of all, it’s the ordering parties that should be interested in suppressing cartels because of the rejected cost cutting that can be used to cover important additional expenses. Unfortunately, the parties that order works and services do not see any problems when competitive biddings ends with the minimum contract prices reduction”, said Muhamed Khamukov.
Finally he gave recommendations to the ordering parties how to prevent anticompetitive agreements within their units and when it is necessary to approach the antimonopoly bodies.
