“MRSK CENTER AND THE VOLGA REGION” PJSC WILL PAY A 600,000 RUB FINE

On 10 May 2018, the Arbitration Court of the Nizhniy Novgorod region recognized legitimacy and reasonableness of the decision and injunction issued by the antimonopoly body

 

On 15.02.2018, Nizhniy Novgorod OFAS found that “MRSK Centre and the Volga region” PJSC committed an administrative offence under Part 2 Article 9.21 of the Code of the Russian Federation on Administrative Violations.

 

“VIP Status” Ltd. filed an application to the grid company for technological connection to increase the capacity of power-receivers in a children’s health camp build built in the Sosnovsky district.

 

In response, “MRSK Centre and the Volga region” PJSC sent a draft contract, according to which the technological connection fee was 21,170,174 RUB 46 kopeks.

 

The grid company explained that the high connection costs are related to absence of free capacity at the nearest substation – “Sosnovskaya”, so a line should be built up from “Lesunovo” substation. These arguments put forward by the grid company, however, were not substantiated.

 

On 15 February 2018, an officer of Nizhniy Novgorod OFAS found that “MRSK Centre and the Volga region” PJSC committed an administrative offence under Part 2 Article 9.21 of the Code of the Russian Federation on Administrative Violations.

 

The company was imposed an administrative fine – 600,000 RUB. “MRSK Centre and the Volga region” PJSC also was ordered to eliminate the causes and reconsidered the application of conditions that had facilitated the violation. The grid company should have reconsidered the application of “VIP Status” Ltd. and draft a new contract for technological connection from “Sosnovskaya” substation.

 

“MRSK Centre and the Volga region” PJSC appealed tothe Arbitration Court of the Nizhniy Novgorod region.

 

TheArbitration Court of the Nizhniy Novgorod regionrecognized legitimacy and reasonableness of the decision and injunction issued by the antimonopoly body and dismissed the claim of “MRSK Centre and the Volga region” PJSC.
