A NEW MONOGRAPH – “IMPORTANT ASPECTS OF ANALYSING THE STATE OF COMPETITION ON THE MARKETS”

The book authors are lecturers of Siberian Institute of Management – a branch of Presidential Academy of National Economy and Public Administration, Irina Knyazeva and Sergey Chirikhin  

The monograph focuses on the most controversial issues in analysis of the state of competition on the markets; the methodology of such analysis is considered through summarizing foreign and Russian experience.

The authors paid special attention to practical aspects of applying the current regulatory framework of the Russian Federation, giving detailed comments and typical cases. They also looked into expert opinion and their roles in judicial decisions and research practice.

In the methodological comments the authors emphasize that decisions made by lawyers without a deep understanding of the economic essence of market performance as well as analytical conclusions of economics reached without knowledge of competition norms often will be superficial and will not achieve the main goal – making decisions to the benefit of competition protection.

“The modern practice of investigating cases related to violations of the antimonopoly law requires increasingly more careful study of specific and substantive aspects, understanding of which needs professional knowledge and opinions, using experience of systemic analysis, the skill to engage broad evidence”, point out Irina Knyazeva and Sergey Chirikhin.

In the researchers’ opinion, analysis of the state of competition is a cornerstone of competition policy since it answers the key question about its efficiency and enables building up certain forecasts and making changes to the composition, content and the nature of using tools and remedies by both market subjects and the regulators. Based on such analysis, market agents may make decisions on market entry, intensifying or curtailing the efforts to strengthen their position or exit the market.

The authors underline that the specifics of expert engagement in consideration of antimonopoly disputes and the expert influence on the outcome of judicial proceedings practically have not studied by scholars. The work is presented for the first time under an academic study on “Analytical and expert support to investigating cases on violating the law under the scope of FAS activities”. The team of researches of Siberian Institute of Management – a branch of Presidential Academy of National Economy and Public Administrationperformed qualitative and quantitative analysis of the practice of engaging experts in investigating antimonopoly cases.

The monograph can become a professionally important and interesting work for scholars and experts involved in theoretical and practical research in the filed of competition policy, economists and lawyers, specializing in research of competitive markets and practicing in competition law, university students and specialists of the antimonopoly bodies.
