RACHIK PETROSYAN: CONSTRUCTION INDUSTRY WILL UNDERGO IMPORTANT TRANSFORMATIONS

The Federation Council approved FAS amendments designed to reduce administrative barriers in the construction sector

 

FAS draft law, expanding the grounds for appealing actions of the urban planning authorities at the antimonopoly body, has passed the third reading at the State Duma and is approved on 24th July 2018 by the Federation Council.

 

Deputy Head of FAS Rachik Petrosyan emphasized: “The construction industry will undergo important transformations. The draft law will accelerate and simplify protections of businessmen’s rights and decrease violations by the authorities. For example, complaints about unreasonable refusals by the authorities to accept documents will take no longer than 7-14 days. Reducing administrative barriers in the industry, specified in theNational Plan for Developing Competition in Russia will improve business climate in urban planning”.

 

Today complaints against the authorities are considered under the fast-track procedure only on the basis of two grounds: breaching the deadline for the procedures from the Exhaustive List, or setting requirements for a procedure not included in the List.

 

FAS amendments add new grounds to Article 18.1 of the Federal Law “On Protection of Competition” to appeal actions of the authorities under the fast-track procedure. It concerns unlawful refusals by the authorities to accept documents and statement and on setting unlawful requirements to the petitioners and their documents.
