PRESIDENT OF RUSSIA SIGNED A LAW TO REDUCE ADMINISTRATIVE BARRIERS IN THE CONSTRUCTION SECTOR
The law expanding the grounds for appealing actions of the authorities in the construction sector comes into effect on 10 August 2018
The amendments drafted by the Antimonopoly Service add new grounds to Article 18.1 of the Federal Law “On Protection of Competition” for FAS to consider complaints against the authorities under the fast-track procedure. It concerns unlawful refusals by the authorities to accept documents and applications as well as setting unlawful requirements to the applicants and their documents.
Until the law comes into force, complaints against the authorities are considered under the fast-track procedure (7-14 days) only on the basis of two grounds: breaching the deadline for the procedures from the Exhaustive List*, or setting requirements for a procedure not included in the List. From 10 August 2018 businessmen will be able to defend their rights quicker and on more grounds.
“The law will reduce the number of administrative barriers in the sector, decrease violations by the authorities and improve the business climate in the urban development area. The amendments were provided for by the National Plan for Developing Competition in Russia, one of the objectives of which is to reduce the number of violations of the antimonopoly law by the state sector”, emphasized Head of FAS Igor Artemiev.
