COURTS OF TWO INSTANCES SUPPORTED SARATOV OFAS IN A DISPUTE WITH THE FEDERAL PROPERTY INESNTORY AND REGISRAITON AUTHOIRTY

Appeal Court supported Saratov OFAS and pronounced legitimacy of a 562 500 RUB fine upon “Rostechinventarizatsia –“Federal Property Inventory and Registration Authority” (further on referred to as BTI)

Earlier OFAS received a petition from the authority of Petrovsky Municipal District, the Saratov region, about unlawful activity of BTI.  In the course of the investigation, it was revealed that the shareholding company had fixed different prices for its services on 562 500 documents for legal and physical entities. FAS suspected that BTI violated Article 10 of the “Federal Law on Protection of Competition and held the company administratively liable.

BTI attempted to appeal OFAS ruing at Arbitration Court of the Saratov region, and then at the 12^th Arbitration Appeal Court, and then in the 12^th Arbitration Appeal Court. The claim however was dismissed and the claimant supported the competition authority.
