THE PRESIDENT OF THE RUSSIAN FEDERATION SIGNED A DRAFT LAW ON UNIFYING STATE DUTY FOR CONSIDERING PREJUDICIAL DISPUTES AND DISAGREEMENTS ON TARIFFS

The law comes into force after a month from the date of its official publication

 

FAS points out that before April 2018, Russia had 10 different procedures for considering tariff disputes and disagreements, described in five acts of the Government of the Russian Federation. A regulated organization could approach FAS on the same issues using different procedures, with different limitation periods and decision-making procedures.

 

Two state duties existed for FAS exercising the same legally significant actions: the state duty for considering disagreements was 80 000 RUB, and 160 000 RUB for prejudicial dispute consideration.

 

On 30 April 2018, a Decree of the Government of the Russian Federation approved common rules for considering disputes and disagreements related to setting and applying tariff and abolished the existed 10 contradictory procedures.

 

Deputy Head of FAS Sergey Puzyrevskiy: “Thus, the Decree unified the procedure for considering the above disputes and disagreements. The Tax Code provisions that determined the size of the state duty remained unchanged and were unreasonably differentiated. To improve the law of the Russian Federation, FAS drafted a law on amendments to the Tax Code”.

 

On 12 November 2018, the President of the Russian Federation signed a draft law on unifying the state duty for considering prejudicial disputes and disagreements on tariffs.

 

“The Decree established the single state duty - 120 000 RUB for the antimonopoly body making decisions on petitions for considering disputes and disagreements related to setting and applying prices ”, stated Deputy Head of FAS.

 

“The document drafted by the antimonopoly authority is a part of the packages of measures designed to unify the law on tariff regulation”, summed up Sergey Puzyrevskiy.
