FAS ISSUED WARNINGS TO TWO DEPARTMENTS IN THE MOSCOW GOVERNMENT

Signs of an antimonopoly violation in the actions of the Department of Education and Science and the Information Technologies Department

FAS received a complaint from an economic entity that the Department of Education had issues an order to us the information resources of “Moscow Electronic School” (MES) as a mandatory condition for subsidies to private educational establishments in Moscow.

In its turn, the Information Technologies Department avoided connecting third-party automated electronic academic progress record-keeping systems (electronic diaries, logs) used by to MES informational resources.

The actions of the Department of Education and Science and the Information Technologies Department of the Moscow Government have signs of breaching the Federal Law “On Protection of Competition” * and can unreasonably restrict the range of economic entities operating on the market of automated electronic academic progress record-keeping systems and electronic diaries in Moscow and obstruct smooth operations of economic entities on the markets, as well as restrict private educational establishments in Moscow in their choice of economic entities providing automated electronic academic progress record-keeping systems and electronic diaries.

The warnings are designed to change the situation when private educational establishments in Moscow are forced to shift to MES informational resources and refuse to work with economic entities providing third-party informational systems (software products) not MES-related, which later may restrict competition in Moscow.

Under Article 39.1 of the Federal Law “On Protection of Competition”, the antimonopoly body issues warnings to stop actions (omissions), which have elements of violating the antimonopoly law, when it exposes signs of violating, in particular, Clause 2 Part 1 Article 15 of the Federal Law “On Protection of Competition” and Clause 5 Part 1 Article 15 of the Federal Law “On Protection of Competition”.
