ANDREY TENISHEV DISCUSSED CRIMINAL LIABILITY FOR CARTELS

Head of FAS Anti-Cartel Department explained that FAS exposes more than 600 anticompetitive agreements annually, two thirds of which are cartels

 

He said that in spite of a growing number of criminal cases against top executives, still there are considerably more administrative proceedings against economic entities.

 

Andrey Tenishev talked about it during the XVI International Research-to-Practice Conference dedicated to the memory of M. Kovalev in Yekaterinburg where he took part in a panel discussion “Business mistakes and their consequences: risk or crime?”

 

Changing the criminal law policy of the state is one of important ways to develop competition as a constitutional value. It is necessary to thoroughly revise offences specified in Chapter 22 of the Criminal Code of the Russian Federation in terms of their actual public danger. Criminal liability emerges for cartels if the cartel revenue exceeds 50 million RUB. We submitted a draft law to the Government of the Russian Federation that doubles this sum to 100 million”, added the speaker.
