FAS PUBLISHED EXPLANATIONS “ON APPLYING PARTS 7, 8 ARTICLE 11 OF THE FEDERAL LAW “ON PROTECTION OF COMPETITION”

The Explanations are issued due to absence of uniformity in the practice of applying the norms of the Law to find out whether cartels between close affiliates are allowed
The document is approved by FAS Presidium.
The Explanations contain provisions on applicability of Parts 7, 8 Article 11 of the Federal Law “On Protection of Competition” considering whether cartels between economic entities – members of a group of person under Clause 7 Part 1 Article 9 of the Federal Law “On Protection of Competition” are allowed.
Thus, investigating cases opened under Articles 11 and 11.1 of the Federal Law “On Protection of Competition”, it is necessary to be guided by the above Explanations.
