THE FIRST ISSUE OF FAS JOURNAL – “RUSSIAN COMPETITION LAW AND ECONOMY” IN 2019

The first issue of “Russian Competition Law and Economy” in 2019 coincides with the 15th anniversary of FAS

 

On 9 March 2004, No.314 Order of the President of the Russian Federation “On the system and structure of federal executive bodies” formed the Federal Antimonopoly Service. The Order transfers the control and supervision functions from the abolished Mimicry for Antimonopoly Policy and Support of Entrepreneurship to FAS (except the functions in the filed of protecting consumer rights and support to small business and the transformed Federal Energy Commission. In a historically short period, FAS have come a long way, the milestones of which should yet be set.

 

At the same time, as Head of the Federal Antimonopoly Service Igor Artemiev points out in his address to colleagues and associates, there is already a need to sum up particular results of the 15-year FAS development and choose the avenue for further development (http://15years.fas.gov.ru). This choice requires deep comprehension of FAS key achievements and development failures in the context of 2003-2004 administrative reform, as a result of which the executive power system has obtained a new structure.

 

A fair assessment of what has happened throughout these years with the goal-setting and practice of the administrative reform, in our opinion, is one of the key lessons of the 15-year development of the antimonopoly regulator (an introductory paper by S. Maximov).

 

The issue contains papers on the history and problems of establishing the institution of self-regulation in Russia (Andrey Kashevarov); analysis of the concept of advertising (Ye. Kosyrev); development of competitive bidding institution вопросам within the framework of the competition law  (А. Molchanov); impact of antimonopoly compliance upon liability of legal entities (V. Fadeev); antimonopoly leniency (I. Akimova, L. Vovkivskaya); and some other pressing issues of the competition law and the economic theory of competition.

 

The journal also publishes the first quarterly review of the practice of FAS Appeal Collegium (K. Alyoshin), as well as a review of the Round Table on anti-cartel enforcement practice (February 2019, organized by the Corporate Counsel Association of Russia with participation of FAS and the Ministry of Interior).
