Over the past 10 years, the BRICS competition authorities have continuously deepened practical interaction and created the necessary institutional system for the further progressive development of multilateral cooperation.

An important institutional element in the joint work of the antimonopoly authorities of the BRICS countries has become the BRICS Competition Conference.

VI BRICS International Competition Conference will be held on September 16-19, 2019 in the Russian Federation (Moscow) under the leitmotif “10 years of successful cooperation between the BRICS competition authorities: results and prospects”.

Nowadays the food industry is experiencing an important shift in the dynamics of competitive development. Relationship between competition law and intellectual property protection standards to ensure fair and non-discriminatory access to selection invention and new technologies is coming to the forefront, as well as issues related to the social and economic impact of transactions of economic concentration and unfair practice of the subjects of global food chains. Meeting of the Working Group on global food value chains will be devoted to discussing the new challenges faced by the competition authorities while ensuring fair competition in the food market. Participants will share their experience in conducting investigations and reviewing M&A’s in this market, jointly identify important issues for further discussion and develop a concept for the future activities of the Working Group.

Within the meeting of the BRICS Working Group in pharmaceutical markets, the participants will discuss issues of fair pricing in the medicines circulation markets, in particular the relationship between the volume of generic production and the price level. The speakers will pay particular attention to discussing the issue of finding a balance between antitrust regulation and compulsory licensing of intellectual property rights in the BRICS pharmaceutical markets.

Within this session, the participants will discuss the main achievements and advantages of the cooperation of antimonopoly authorities in bilateral format as well as in the framework of international organizations. The parties will give examples of successful cooperation and consider the prospects for the development of cooperation of countries in the consideration of specific cases of violation of antimonopoly legislation, as well as in the analysis of global M&As. Besides, great attention will be paid to the results of interaction in the framework of the BRICS Working Groups for the research of competition issues in socially important markets. Participants will also discuss new opportunities for expanding the five-sided cooperation on the basis of the BRICS Competition Law and Policy Center.

Technological development underlies economic growth and stimulates the development of innovations. At the same time, the digitalization of the global economy requires the transformation of antimonopoly regulation, the adaptation of regulatory approaches to new realities, and the revision of competition policy in the context of its applicability to the era of the digital economy. Within this session, the participants will consider key issues related to the development of competition and the improvement of antimonopoly laws in the digital economy.

Within this session, the participants will look at examples of recent mega-mergers, as well as discuss tools and mechanisms for international cooperation when considering global M&As.
