OKSANA KUZNETSOVA: ALL REGIONS IN RUSSIA STARTED INTRODUCING ANTIMONOPOLY COMPLIANCE
The system is designed to ensure observance of the antimonopoly law and prevent its violations
Deputy Head of FAS Legal Department Oksana Kuznetsova reported at the workshop of regional FAS Offices in the South Federal District in Rostov-on-Don.
She said: “Efficiency of such work can be evaluates in different manners, some regions have managed to adopt such acts and organize an antimonopoly compliance system in every executive body. In some regions the efforts is this area are still being undertaken".
Oksana Kuznetsova stated that there are already the first positive examples of such work. For instance, in an executive body in the Moscow region a compliance act provides for feedback from market participants, particularly as an option to submit comments on the current acts of regional authorities; and in the Altai region the staff is liable for violating the compliance procedure. The first shortcomings of the system are also revealed.
"A collegial body was formed in a Ministry from the ministerial staff. In our opinion, such practice cannot provide independent public control”, added Oksana Kuznetsova.
The first results of the system performance will be summed up at the end of the year.
She also presented the results of FAS in-house appeal. Overall, 909 statements were received by FAS Administrative Appeal and Methodology Unit in 2018.
“Establishing uniform practice for enforcement of the Federal Law “On Protection of Competition” is aimed, in particular, at increasing legal certainty of antimonopoly regulation and this work will certainly continue”, concluded Oksana Kuznetsova.
