“RTS-TENDER” ELECTRONIC SITE UNLAWFULLY DEPRIVED PHYSICAL PERSONS OF THE RIGHT TO TAKE PART IN TRADING

The antimonopoly body ordered to re-do the auctions

 

FAS received complaints from two physical persons regarding actions of the operator of an electronic site – “RST-Tender” Ltd. in the course of auctions for selling municipal property – a non-residential unit and a land plot.

 

The physical persons paid deposits for participating in the auction and transferred the necessary amount to the account of the e-site operator for the auction services. Their participation in the auction was rejected, however, due to “non-receipt” of the deposits.

 

The auction organizer – Cheboksary City Committee on Property Management –explained that its “personal account” on the operator’s site did not display deposit payments of most auction participants, so it was necessary to reject 8 out of 15 applications. The e-site operator refused to give information to the auction organizer about the received payments without a request from the regulator or Court.

 

Deputy Head of FAS Department for Control over Construction and Natural Resources, Olesya Malaya commented: “FAS Commission believes that “RST-Tender” Ltd. had failed to provide technical possibility to the applicants for taking part in the auction and ordered to abolish the protocols on two lots and set the new deadline for filing applications”.

 

“Auctions in the electronic format attract a lot of participants from all corners of Russia. This is good in terms of competition. At the same time, FAS sees violations of the procedures: for various reasons e-site operators refuse applications for auctions. If something like this has happened with you or your company, you can always approach the antimonopoly authority”, emphasized Deputy Head of FAS Rachik Petrosyan.
