FAS OPENED A CASE AGAINST A CONSTRUCTION CARTEL BASED ON THE MATERIALS OF A CRIMINAL CASE

FAS suspects that “Stroiline” Construction Company” Ltd. and “Vympel” Ltd. formed a cartel. Analyzing the materials of a criminal case, the Antimonopoly Service exposed elements of collusion between “Stroiline” Ltd. with the ordering party – “RusHydro” PJSC.

 

As part of cooperation, the Investigation Department of the Ministry of Interior in Khakassia, forwarded materials of a criminal case. Opened upon elements of an offence under Clause “a” Part 2 Article 178 of the Criminal Code of the Russian Federation, to the antimonopoly body.

 

Having analyzed the materials, the Federal Antimonopoly Service opened a case against “Stroiline” Construction Company” Ltd. and “Vympel” Ltd. upon signs of a cartel in the course of construction procurement (Clause 2 Part 1 Article 11 of the Federal Law “On Protection of Competition”), as well as against “RusHydro” PJSC and “Stroiline” Ltd. upon elements of creating preferential conditions for a bidder - “Stroiline” Construction Company” Ltd.  by the ordering party for construction works at  Sayano-Suhushenskaya hydroelectric power station (Clause 1 Part 1 Article 17 of the Federal Law “On Protection of Competition”).

 

Head of FAS Anti-Cartel Department, Andrey Tenishev commented: “Exposing and suppressing construction cartels is a priority for FAS”.

 

He also pointed out that “interaction with the law enforcement bodies is one of the key factors for efficient exposure and suppression of cartels in the most important spheres of life of our population”.

** Collaboration with the law enforcement bodies take place in accord with the inter-departmental programme of exposing and suppressing cartels and other competition-restricting agreements for 2019 - 2023 drafted by FAS to execute the instructions of the President of the Russian Federation in order to establish e4fficient uniform anti-cartel practice, approved by the Government.
