COMPLIANCE SHOULD BE IMPLEMENTED TO PREVENT OF VIOLATIONS
FAS Centre for Education and Methodology organized a qualification-advancement course on “Implementing antimonopoly compliance by the authorities and local self-government bodies. The training was attended by representatives of organization implementing in-house antimonopoly compliance.
The lecturers offered an intensive programme where they explained the concept of compliance, types of antimonopoly risks, legal regulation of anticompetitive regulations, antimonopoly risk management, as well as how to draft a Road Map.
The event was opened with a lecture by Deputy Head of FAS Legal Department, Oksana Kuznetsova, who detailed the concept of compliance:
“Antimonopoly compliance is a set of legal and organizational measures provided for by in-house acts or acts by the authorities or local self-government bodies that apply to such administrative bodies or their subordinate entities and are aimed at conformance with the antimonopoly law and preventing it violations”, highlighted Oksana Kuznetsova.
The speaker informed that many commercial entities and high-profile companies such as “Sibur”, Uralkalii”, “Baltika”, “MTS”, “Danone” have already implemented antimonopoly compliance systems that are quite successful. She pointed out that adopting antimonopoly compliance is voluntary.
Deputy Head of FAS Anti-Cartel Department, Anton Teslenko, informed the listeners about the work of the antimonopoly body.
He stated that around 500 cases on anticompetitive agreements were opened in H1 2019.
“It is essential to understand that compliance should be implemented to prevent violations rather than conceal its traces”, commented Anton Teslenko.
Finally, lecturers organized a business game, where teams of participants had to assess various situations in terms of probability of antimonopoly violations and the severity of their adverse consequences.
The course was offered for already the second time; the first course was attended by 176 representatives from 49 regions of Russia.
