FAS DECISION ON “BELGOROD LANDS” IS SUPPORTED BY THREE COURTS

The violators did not agree with FAS decision and proceeded with an appeal up to Cassation Court, which, however, supported the antimonopoly body

Arbitration Court of the Moscow District upheld the FAS decision on the case against the Department of Property and Land Relations of the Belgorod region, “Belgorod Land Fund” JSC, “Krasnenskaya” Agro-Firm” Ltd., and “Yamskaya Step” Ltd.

Earlier FAS found that the Department of Property and Land Relations of the Belgorod region, “Belgorod Land Fund” JSC, “Krasnenskaya” Agro-Firm” Ltd., and “Yamskaya Step” Ltd. violated Part 4 Article 16 of the Federal Law “On Protection of Competition”: concluding and participating in an anticompetitive agreement that resulted in restricting access to the market of lease (sub-lease) of land plots owned by the Belgorod regions.
