COURT ONCE AGAIN SUPPORTED FAS IN THE CASE ON SMS- MESSAGING

On 18 March, Moscow Arbitration Court supported FAS in a case opened against “T2 Mobile” for violating the antimonopoly law in the course of providing sms-messaging services

 

Having considered the antimonopoly cases opened upon complaints form banks, FAS found that “T2 Mobile” violated Clauses 1, 8 Part 1 Article 10 of the Federal Law “On Protection of Competition”.

 

 “T2 Mobile” considerably increased the tariffs for sms-messaging and fixed different sale conditions for different consumer groups.

 

FAS also investigated similar cases against “MegaFon”, “VympelCom” and “MTS”.

 

According to FAS orders, the communications providers must restore the situation with the tariffs for sms-messaging service that existed before the violation.

 

Deputy Head of FAS Anatoly Golomolzin pointed out: “In this particular case and in general judicial practice on considering cases against all communications providers offering sms-messaging services are in favour of FAS”.
